What are the eviction rules of Landlord tenant board?


If you are a landlord who wants to end a tenancy and evict a tenant, you must follow the rules and procedures set out by the Residential Tenancies Act and the Landlord and Tenant Board (LTB). Here are the main steps you need to take:

- Provide a notice terminating the tenancy giving the reasons. You must use the proper form provided by the LTB and give it to the tenant within the time period required by law. The form must state the reason for eviction, such as rent arrears, illegal act, personal use, etc. You cannot evict a tenant for reasons that are not allowed by the Act, such as discrimination, retaliation, or bad faith.

- Apply to the LTB for an order to evict a tenant. If the tenant does not move out or does not agree with your notice, you can apply to the LTB for an order allowing the eviction of the tenant. You must pay a fee and file your application within 30 days of giving the notice to the tenant. You must also serve a copy of your application and a Notice of Hearing to the tenant.

- Present evidence at the hearing as to why a tenant is being evicted. The LTB will schedule a hearing where you and the tenant can present your evidence and arguments. The LTB will consider all the facts and circumstances of the case and decide whether to grant or deny your eviction order. The LTB may also order you or the tenant to pay money or do something else.
